Privacy Policy
Effective date: October 30, 2026 · Last updated: October 30, 2026
This Privacy Policy explains how Swade Soul Enterprise LLC, a Wyoming limited liability company ("Swade Soul," "we," "us"), collects, uses, shares and protects personal information when you use the Services listed in Schedule A of our Terms of Service. ABAGALE is operated separately and has its own policy.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising.
1. Information we collect
You give us:
- Account details: name, email, password (stored hashed) or sign-in provider, profile and artist or business details.
- Purchases: plan, amounts and billing details. Card details go directly to our payment processor; we do not store full card numbers.
- Your Content: music, audio, video, images, books, courses, apps, prompts, messages, comments and anything else you upload or create.
- Voice and likeness data: voice recordings and samples, photos or video you submit for voice personas, AI artists, lip-sync or avatars. See Section 4.
- Call-ins and messages: recordings and phone numbers if you call in to a station or leave a voice message.
- Payout and tax details if you sell or receive royalties, handled through our payment processor.
- Support and legal requests, including copyright notices.
We collect automatically:
- Device and usage data: IP address, browser and device type, pages and features used, listening and viewing activity, approximate location derived from IP, and diagnostic logs.
- Cookies and similar technologies needed to keep you signed in, remember settings and keep the Services secure. Some Services use analytics tools to understand how features are used. We do not use cookies to sell your information or for cross-context behavioral advertising.
- Precise location, only when you ask. If you use "my location" (for example in God's Eye or a local station), your device shares its position for that request. We do not track your location in the background.
From others: sign-in providers you choose (for example Google), payment processors, platforms you connect (for example streaming, social or distribution accounts), and people who send us information about you (for example a co-writer's credit or a copyright notice).
2. How we use information
- Provide and operate the Services, including broadcasting, distribution, storefronts, AI features and customer support (to perform our contract with you).
- Process payments, payouts, subscriptions and refunds.
- Keep the Services safe: prevent fraud, abuse, spam, infringement and security incidents.
- Improve and fix the Services, including measuring which features are used.
- Communicate with you about your account, purchases, changes to terms, and, if you agree, news and offers. You can unsubscribe from marketing at any time.
- Follow the law, enforce our terms, and respond to legal requests.
AI processing. When you use an AI feature, your prompt and any content you supply are sent to the AI model provider that powers that feature, to produce the result. We do not allow providers to train their foundation models on your private uploads where we can control that setting, and we do not use your private uploads to train third-party models without your permission.
3. How we share information
We share personal information only:
- With service providers that run parts of the Services for us under contracts that limit their use of your data, including: cloud hosting and servers (Hostinger), file storage (Backblaze), payments and payouts (Stripe), AI model providers (such as Alibaba Cloud Qwen, Anthropic, OpenAI and Google), music-generation and voice processing providers, phone and messaging (Twilio), email delivery, map and geocoding services (OpenStreetMap-based services, NASA imagery, RainViewer), and analytics providers. An up-to-date list is available on request at legal@brainiak.live.
- Publicly, when you choose. Artist pages, stations, storefronts, broadcasts, comments and anything you publish are visible to others.
- With partners you direct us to, such as distribution platforms for your releases, stores for your products, or apps you connect.
- With buyers and sellers in our marketplaces as needed to complete a transaction (for example, your delivery address to the restaurant or courier).
- For legal reasons: to follow the law or a valid legal request, to protect rights, safety and property, or to investigate fraud or abuse.
- In a business transfer, such as a merger, financing or sale of assets, subject to this Policy.
4. Voice, face and likeness data
Some Services let you create voice personas, AI artists, lip-sync or avatars from recordings, photos or video. Some laws treat voiceprints and face geometry as biometric identifiers.
- We collect it only with your consent, given when you submit it, and only for the purpose you choose (for example, creating a voice that sings your songs).
- If it is someone else's voice or likeness, you must have their written consent, and they can ask us to delete it.
- We do not sell, lease or trade voice or likeness data, and we do not disclose it except to the service providers that process it for that purpose, or where the law requires.
- We delete it within a reasonable time after the purpose you gave it for ends (for example, when you delete the voice persona, AI artist or your account), and no later than one year after that, unless another law requires us to keep it longer.
- We protect it with at least the same care we use for our most sensitive information.
5. How long we keep information
We keep personal information for as long as your account is active and as needed to provide the Services, then delete or anonymize it, except where we need to keep it longer to meet legal, tax or accounting obligations, resolve disputes, or enforce our agreements. Backups are overwritten on a rolling schedule. Broadcast logs and play records may be kept to report plays, pay royalties and answer sponsors. Content published to decentralized storage may not be deletable (see Product Terms B7).
6. Security
We use reasonable technical and organizational safeguards, including encryption in transit, access controls, secrets kept server-side, and logging. No system is perfectly secure. If a breach affects your personal information, we will notify you and authorities as the law requires.
7. Your choices and rights
Depending on where you live, you may have the right to:
- access the personal information we hold about you and get a copy;
- correct inaccurate information;
- delete your information;
- opt out of targeted advertising, sale, or profiling with significant effects (we do not do these);
- withdraw consent you gave (for example for voice data or marketing);
- appeal our decision about your request.
To use these rights, email privacy@brainiak.live or use the settings in your account. We will verify your identity before acting and answer within the time the law requires (generally 45 days). You may use an authorized agent where the law allows. We will not discriminate against you for using your rights. If we deny your request, you can appeal by replying to our decision; if you are still unhappy, you may contact your state attorney general.
You can also turn off location access in your device settings, delete content or your account in your settings, and unsubscribe from marketing emails with the link in each email.
8. Children
The Services are not for children under 13, and accounts are for people 18 and older. We do not knowingly collect personal information from children under 13. If you believe a child has given us information, contact privacy@brainiak.live and we will delete it.
9. International users
We are based in the United States and process information in the United States and other countries where our service providers operate. Those countries may have different data protection laws than yours. Where required, we use appropriate safeguards for transfers.
10. Changes to this Policy
We may update this Policy. If a change is material, we will notify you before it takes effect, for example by email or an in-app notice.
